Stage 1 - Application For Divorce
Let us help you through this
The Application for divorce is the first step and the good news is that you dont have to wait or one person has to be in at fault
We will submit your petition for you online. Monitor the progress, report your spouse response and deal with the interim order (decree nisi) and apply for an decree absolute which is the final order.
If you situation changes we are able help and if necessary refer you on to specialist family law barristers. Their fees are NOT included in this package.
Stage 2 - Acknowledgement of Service
The Acknowledgement of Service is a document that your receives from the Court together with the divorce application. They tell the Court if they wish to defend the case or not.
If your spouse delays things then DON’T DESPAIR! There are ways you can still keep your divorce moving forward even when your spouse drag things out by not completing the return of service. The Court simply need to be sure that your spouse is aware that you are applying for a divorce. Normally they can acknowledge service online and we will let you know when this is done. If not we are here to help you if things become delayed. This may mean getting a process server to serve a copy of the petition. Those fees would be extra and we will discuss them with you if needed. In most cases the responding spouse acknowledges service so any special measures are not needed.
Stage 3 - Application for Decree Nisi
This is the first of the two divorce orders issued by the Court. It is a conditional order
You must have both orders before you are finally divorced or your civil partnership is dissolved. A judicial separation decree or separation order is the final document issued by the court.
Stage 4 - Application for Decree Absolute
This is the second and final divorce order issued by the Court.
The decree absolute means that you are divorced. You are no longer married and free to marry again if you wish. You should always final order or decree absolute safe place. You will need to show it if you remarry or need to to prove your marital status.
The application is made 6 weeks after the decree nisi.
